Terms and Conditions
These Terms and Conditions (“Terms”) govern registration and participation in simulation training courses (“Courses”) offered by Northeast Simulation Training Associates LLC (“Provider,” “we,” or “us”). By registering for a Course, the individual or organization (“Customer”) agrees to these Terms.
1. Definitions
• Attendee: Any individual registered for and attending a Course.
• Training Materials: All Course content, handouts, presentations, recordings, and related materials provided by the Provider.

2. Registration and Payment
2.1. All fees are due at the time of registration. Fees may include applicable taxes, which are the Customer’s responsibility.

3. Cancellations and Refunds
3.1. Customer Cancellations / No-Shows
Customers are responsible for the full Course fee for any Attendee no-shows. The Customer is also responsible for any non-refundable travel, accommodation, or other expenses already incurred by the Provider in connection with the Course.
3.2. Provider Cancellations
The Provider reserves the right to cancel or reschedule a Course at any time due to insufficient enrollment, instructor availability, or other unforeseen circumstances. In such cases, the Customer may choose either a full refund or transfer to a future course date.

4. Attendee Code of Conduct
4.1. Attendees must follow all instructions and policies communicated by the Provider during the Course. Attendees may not:
• Harass, abuse, or threaten any Course participants or staff;
• Infringe upon the intellectual property rights of the Provider or third parties;
• Solicit other participants for business or personal purposes without consent;
• Collect or distribute personal information about other participants without authorization.
4.2. The Customer agrees to indemnify and hold the Provider harmless against any claims, damages, or expenses (including reasonable attorney’s fees) arising from an Attendee’s conduct, breach of these Terms, or participation in the Course.

5. Intellectual Property and Feedback
5.1. All intellectual property rights in the Training Materials remain the property of the Provider or its licensors. No ownership rights are transferred. Attendees may use Training Materials solely for personal learning and may not reproduce, distribute, or share them without prior written consent.
5.2. Any feedback or suggestions provided to the Provider may be used freely by the Provider for any purpose without obligation or compensation to the Customer or Attendee.

6. Warranties and Limitation of Liability
6.1. The Provider warrants that Course instruction will be delivered in a professional and workmanlike manner consistent with industry standards. Except as expressly stated, all warranties—express or implied—are disclaimed, including implied warranties of merchantability or fitness for a particular purpose.
6.2. To the fullest extent permitted by law, the Provider’s total liability for any claim related to the Course shall not exceed the total fees paid by the Customer for that Course.
6.3. The Provider is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of such possibilities.

7. General Provisions
7.1. These Terms constitute the entire agreement between the Provider and the Customer regarding the Course.
7.2. Any amendments must be in writing and agreed upon by both parties.
7.3. If any provision is deemed invalid, the remaining provisions shall remain in effect.
7.4. The Provider shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including acts of nature, civil unrest, labor disputes, or government actions.
7.5. These Terms are governed by the laws of the State of New Hampshire, and any disputes shall be resolved exclusively in the state or federal courts located in New Hampshire.

8. Photo and Video Release
By registering for or participating in the Course, the Customer and Attendees grant the Provider a perpetual, irrevocable, worldwide, royalty-free license to photograph, film, and otherwise record their likeness, image, and voice during any Course session or related activity. The Provider may use such recordings and images for any lawful purpose, including but not limited to training, marketing, promotional, or archival use, in any media now known or later developed, without notice, approval, or compensation. Attendance at the Course constitutes consent to such use.
